TrackPro Terms of Service

These Terms of Service ("Terms") govern your access to and use of TrackPro, operated by [LEGAL ENTITY NAME] ("TrackPro", "we", "us"). By creating an account or subscribing, you agree to these Terms. If you do not agree, please do not use TrackPro.

1. What TrackPro Is

TrackPro is a digital membership for performance drivers. Depending on your plan, it includes the Driver Performance Programme (video lessons), the Drivers Club community, the Tools Hub, the AiPex AI coaching assistant, direct written and video access to Andrew, and, for VIP members, personal onboard lap reviews. We may add, change, or remove features over time.

2. Your Account

You must be at least 18 years old and provide accurate information. You are responsible for keeping your login secure and for everything that happens under your account. Your membership is for you alone. Sharing your login or distributing TrackPro content is not permitted (see section 6).

3. Membership, Billing, and Renewal

Plans and prices are shown on our pricing page in US dollars (USD) and may change with notice. Memberships are billed in advance. Monthly plans are billed each month and annual plans each year, and they renew automatically until cancelled. By subscribing, you authorise us and our payment processor to charge your payment method on each renewal.

Applicable taxes are calculated at checkout. You can cancel at any time from your account or by emailing us. Cancellation stops future renewals, and your access continues until the end of the paid period.

4. Refunds

New memberships are covered by our 14-day money-back guarantee, and refunds are otherwise governed by our Refund Policy, which forms part of these Terms.

5. The Coaching Content Is Guidance, Not a Guarantee

TrackPro provides education, frameworks, and opinion to help you understand vehicle dynamics and driving technique. Driving, and motorsport in particular, is inherently dangerous. Our content, tools, and the AiPex assistant are general guidance only. They are not instructions for any specific car, track, condition, or situation, and they are no substitute for your own judgement, proper safety equipment, qualified in-person instruction where required, and compliance with the rules of any venue or event. We do not guarantee any particular result, lap time, or improvement.

6. Intellectual Property

All TrackPro content, including videos, written material, tools, graphics, and the AiPex assistant, is owned by TrackPro or its licensors and is protected by law. While your membership is active, we grant you a personal, non-transferable, non-exclusive licence to access the content for your own learning. You may not copy, record, download (except where we expressly allow), share, resell, publish, or use the content to build a competing product. This licence ends when your membership ends.

Content you post in the community remains yours, but you grant us a licence to host, display, and use it to operate and promote the community.

7. Acceptable Use

You agree not to share or resell access, reproduce or redistribute our content, harass other members or post unlawful, abusive, or misleading content, attempt to disrupt or gain unauthorised access to the platform, or use TrackPro for anything illegal. We may remove content and suspend or terminate accounts that breach these Terms.

8. Assumption of Risk

You acknowledge that driving on track and participating in motorsport carry serious risks, including the risk of property damage, injury, or death, and that these risks are not created or controlled by TrackPro. You participate in any driving activity entirely at your own risk and remain solely responsible for your own safety and for your vehicle. Nothing in TrackPro reduces or transfers that responsibility.

9. Disclaimers and Limitation of Liability

To the fullest extent permitted by law, TrackPro is provided "as is" without warranties of any kind. To the maximum extent permitted by law, TrackPro and Andrew Waite will not be liable for any loss, damage, injury, or death arising from your use of the content, tools, or community, or from any driving or motorsport activity, whether or not informed by TrackPro.

If you are a consumer in New Zealand, nothing in these Terms is intended to limit rights you have under the Consumer Guarantees Act 1993 or other laws that cannot lawfully be excluded. Where TrackPro is acquired for business purposes, the Consumer Guarantees Act does not apply.

To the extent we are ever found liable despite the above, our total liability is limited to the amount you paid us in the 12 months before the claim.

10. Indemnity

You agree to indemnify TrackPro against claims, losses, and costs arising from your breach of these Terms or your misuse of TrackPro.

11. Suspension and Termination

You can cancel at any time. We may suspend or terminate your access if you breach these Terms or to comply with the law. On termination, your right to access the content ends.

12. Changes to These Terms

We may update these Terms from time to time. We will post the updated version here and update the date above, and we will notify members of material changes. Continuing to use TrackPro after changes means you accept them.

13. Governing Law

These Terms are governed by the laws of New Zealand, and the New Zealand courts have non-exclusive jurisdiction over any dispute.
